1. Acceptance of Terms

By accessing or using the Wadem application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the App. We reserve the right to update these Terms at any time, and continued use of the App constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old to use the App. By creating an account, you represent that the information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials.

3. Services

Wadem is a food delivery platform that connects customers with local restaurants. We facilitate ordering, payment, and delivery but are not a restaurant or food provider ourselves. Availability of restaurants and menu items may vary by location and time. Estimated delivery times are approximate and not guaranteed.

4. Ordering & Payment

All prices displayed on the App are in Iraqi Dinar (IQD) and include applicable taxes unless otherwise stated. Prices are set by the restaurants and may change without prior notice. Once an order is confirmed, it cannot be cancelled unless the restaurant has not yet begun preparation. Payment methods include Cash on Delivery and any other methods made available through the App. You agree to pay the full order amount including subtotal, delivery fees, and service fees.

5. Delivery

Delivery is available within our designated service areas. You must provide an accurate delivery address and be available to receive your order. If a delivery cannot be completed due to incorrect address information, unavailability, or refusal to accept the order, you may still be charged for the order. Delivery fees vary by distance and restaurant and are displayed before you confirm your order.

6. Promotions & Discounts

Wadem may offer promotional codes, free deliveries, or discounts from time to time. Promotions are subject to specific terms, including expiration dates, minimum order amounts, and usage limits. Promotions cannot be combined unless explicitly stated. We reserve the right to modify or cancel any promotion at any time without prior notice.

7. Refunds & Complaints

If you receive an incorrect, incomplete, or unsatisfactory order, please contact our support team within 30 minutes of delivery. Refunds or credits are issued at our sole discretion after investigation. Refunds, if approved, will be processed to your original payment method or as App credit. We are not responsible for food quality issues that arise after delivery.

8. User Conduct

You agree not to: use the App for any unlawful purpose; provide false or misleading information; interfere with the operation of the App; attempt to gain unauthorized access to other accounts or systems; abuse, harass, or threaten delivery drivers, restaurant staff, or other users. Violation of these rules may result in suspension or permanent termination of your account.

9. Intellectual Property

All content, design, logos, trademarks, and software associated with the App are the property of Wadem or its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the App without prior written consent.

10. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection, use, and storage of your personal data as described in our Privacy Policy. We collect information such as your name, phone number, delivery address, and order history to provide and improve our services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Wadem shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim. We are not responsible for any delays, failures, or interruptions caused by events beyond our reasonable control.

12. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, restaurants, delivery partners, or our business. Upon termination, your right to use the App ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kurdistan Region of Iraq. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Erbil, Kurdistan Region, Iraq.
